Avatar promotion: terms

• While this promotion runs, each kit you order in our shop comes with one code for the VRChat avatar SPADES [SFW] by Castell. The number of codes is limited.
• You can get the code at facefocusvr.com/redeem once your kit has shipped.
• Your code is reserved for you for 60 days. After that you only get it while codes last.
• The code expires 12 months after your kit shipped.
• The avatar comes from Castell. We are responsible for giving you a working code.

1. Who runs this promotion

This promotion is run by FaceFocusVR - Henrik Sopart, c/o IP-Management #6498, Ludwig-Erhard-Str. 18, 20459 Hamburg, Germany. Email: [email protected]. In these terms, "we" means FaceFocusVR.

2. What you get

While this promotion runs, each kit you order in our shop at shop.facefocusvr.com comes with one promotional code. With the code you can get the VRChat avatar SPADES [SFW] by Castell on Gumroad without paying for it.

• You get one code per kit. Kits are our Face & Eye Tracking Kits for the Valve Index (Hardware Kit and DIY Kit). Replacement parts and accessories are not kits.
• The code is free for you. To redeem it you go through Gumroad's checkout, which asks for an email address. What you need in order to use the avatar is listed on Castell's product page [to be announced].
• The code is a promotional code with no cash value. It cannot be paid out or exchanged for anything else.

3. The avatar is provided by Castell

The avatar is provided by Castell, not by us. When you redeem the code, you enter into a separate agreement with Castell for the use of the avatar. Castell's licence terms [to be announced] and Gumroad's terms apply to it. We do not supply the avatar, we do not distribute any files, and we have no control over its content, its updates or its availability. What we are responsible for: that you receive one working code for each kit that takes part under section 4. If your code does not work, email us at [email protected] and we will give you a new one.

4. Who can take part

• Anyone who orders a kit in our shop while this promotion runs (section 7).
• For orders placed before [to be announced] we give out codes voluntarily, as a thank-you. The same time limits apply to them (section 6).
• There are no codes for cancelled or fully refunded orders, or for kits that were not bought in our shop, for example second-hand.

5. How to get your code

• Once your kit has shipped, you can get your code at facefocusvr.com/redeem. The page shows up to which order number codes are ready.
• You need your order number, the email address of your order and the month in which you placed it.
• Once you have retrieved your code, you can look it up there again as often as you like until it expires.

6. Reservation and validity

All time limits run from the day your kit shipped. The exact dates are shown with your code on the redemption page. They can be later than described here, never earlier.

• Reserved for 60 days. For this long your code is set aside for you. If you retrieve it within this time, you are sure to get it.
• After that, while codes last. You can still retrieve your code as long as it has not been given to someone else. We may give codes that have not been retrieved to other buyers. In that case there is no code for your order any more.
• 12 months at most. The code expires 12 months after your kit shipped. By then you must have retrieved it and redeemed it on Gumroad. After that it expires and is not replaced.
• Orders from before the promotion. If your kit shipped before [to be announced], the time limits run from [to be announced]. Your code is then reserved until [to be announced] and expires on [to be announced].
• A code you have retrieved stays yours until it expires. It can be redeemed once.

7. Limited number of codes and duration

• The number of codes is limited. The promotion runs while codes last.
• We can end the promotion at any time for the future. We will announce the end at facefocusvr.com/redeem and remove the notice from our shop.
• If you ordered your kit while the promotion was announced in our shop, the reservation under section 6 applies even if the promotion ends before your kit ships.
• We can pause handing out codes for a good reason, for example if the avatar is temporarily unavailable. Your time limits under section 6 are extended by the length of the pause.

8. Withdrawal and returns

If you withdraw from the purchase of your kit, or the purchase is fully reversed for any other reason, you are no longer entitled to the code. We may deactivate a code that has not been redeemed yet. This does not cost you anything. Your right of withdrawal and your other rights from the purchase stay unchanged.

9. Passing on and misuse

The code must not be sold. Anyone who tries to manipulate the redemption page or to retrieve other people's codes can be excluded from the promotion, and we may deactivate the codes concerned.

10. Availability of the redemption page

The redemption page may be unavailable at times, for example for maintenance or to prevent misuse. If this stops you from getting your code in time, email us at [email protected].

11. Liability

We are fully liable for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For a slightly negligent breach of an essential obligation, our liability is limited to the damage that is typically foreseeable for a promotion like this one. An obligation is essential if taking part in the promotion depends on it and you can normally rely on it being met. Beyond that, we are not liable for slight negligence.

12. Privacy

How we handle your data when you redeem is described in our privacy policy. When you redeem the code on Gumroad, the privacy rules of Gumroad and Castell apply there.

13. Final provisions

• German law applies. If you are a consumer and live in another country, you keep the protection of the mandatory laws of that country.
• Your rights from the purchase of your kit and the terms of our shop stay unaffected.
• We can change these terms for future orders. Your order is covered by the version that was published on the day you ordered. Orders placed before [to be announced] are covered by the version of [to be announced].
